고국에서 벌어진 대통령의 사법방해 범죄행위가 국제적 관심사로 급부상했습니다.

이 범죄는 대통령에 의해 저질러졌고, 대통령이 그가 지휘할 수 있는 국가공조직들을 동원하여 자신의 범죄를 은폐하기 위한 또다른 중대범죄를 연달아 저지르고 있다는 사실이 문제의 포인트입니다.

어떤 사람을 몇 마디로 평가하기는 어렵습니다. 굳이 표현하자면 그는 미국의 전 대통령이었던 도널드 J 트럼프와 필리핀의 전 대통령 로드리고 두테르테의 나쁜 점들만 모아놓은 사람이라고 생각하시면 가장 사실에 근접한 평가가 될 것 같습니다.

사건의 발단이 된 징집병 사망사건은 어떻게 발생했습니까? 

모범답변: 

그 사건은 지난 해 7 월 19 일 한국 전역에 내린 집중폭우때 발생했습니다. 홍수에 휩쓸려 실종된 민간인들을 수색하기 위해 한국 동남부에 주둔하고 있던 해병부대가 동원되었습니다. 

이 부대의 부대장(해병 제 1 사단장)은 안전수칙을 깡그리 무시한 복장명령을 하달했습니다. 해병대를 상징하는 빨간색 상의에 고무장화를 착용하라는 지시였습니다. 

신체의 절반이 잠기는 하천에 입수하면서 장화를 신는다는 것은 위험천만한 일이었지만 해병대의 상징적 색상대비를 드러내기위해 그런 지시를 한 것이 분명해 보이고, 필수안전기어인 라이프재킷 착용을 못하게 한 것은 해병대를 상징하는 빨간색 상의가 라이프재킷에 가리지 않게 하기 위한 의도였음이 분명해 보입니다.

수중수색작업 중 사망 징집병을 포함한 몇 명의 병사가 물에 휩쓸려들어갔습니다.

다른 병사들은 무사히 구조되었으나, 사망 징집병은 끝내 구조되지 못하고 싸늘한 주검이 된 채 나중에야 발견되었습니다.

위법하고 부당해보이는 지시를 내린 사단장은 처벌받았나요?

당초 해병대 수사기관은 사단장을 포함한 관련자 8 명의 혐의사실을 적시한 수사보고서를 작성하여 사건발생지역 관할 민간 수사기관으로 사건을 이첩했습니다. 

한국의 군사법원법상 군 내부에서 발생한 사건 중 사망과 성폭행사건은 기초수사를 통한 사건인지후 이유여하를 불문하고 지체없이 민간수사기관에 사건을 이첩하도록 되어 있기 때문입니다. 

그런데 사단장의 혐의가 적시된 수사보고서가 이첩된 사실을 알게 된 대통령이 격노하며 사단장에 대한 혐의사실삭제와 민간수사기관이첩취소를 불법적으로 강요하는 사태가 벌어졌습니다.

그가 대통령의 범죄행위에 자발적으로 가담한 것은 아닙니다. 당시 국방부장관이었던 그는 오히려 해병대 수사본부가 당초 작성한 수사보고서에 흔쾌히 동의하고 결재했을 뿐 아니라 참모들의 동의와 지지를 받으며 사건의 민간수사기관이첩을 명령했었습니다. 

그런 그가 어느 날 오전 02-800으로 시작되는 대통령실 전화를 받고나서 혼비백산한 나머지 자신의 명령을 취소하고 해병대사령관을 통해 수사본부장으로 하여금 수사보고서 수정과 민간수사기관으로의 이첩중단을 지시했습니다.

수사본부장은 명백한 불법명령에 저항했습니다. 

대통령은 뜻밖의 저항을 하는 수사본부장을 구속하고 중형이 가능한 혐의로 기소하라는 명령을 내린 것으로 나중에 드러났습니다.

대통령의 이러한 불법무도한 명령은 당시 국방부장관이었던 신임 호주대사를 통해 이루어졌습니다.

대통령이 이제와서 그 국방부장관을 호주대사로 임명한 이유가 무엇인가요?

How did the soldier's death incident, which was the beginning of the case, occur?

The beginning of the incident, the soldier's death, occurred during a heavy rainstorm that struck nationwide on July 19th last year. A Marine unit stationed in the southeast of Korea was mobilized to search for civilians who went missing due to flooding. The commander of this unit (Commander of the 1st Marine Division) issued a dress code order that blatantly disregarded safety protocols. It instructed Marines to wear white rubber boots with their red uniform tops, a combination that is dangerous when entering waters that submerge half of the body. This order seemed to prioritize the symbolic color contrast of the Marine uniform over safety concerns, as it prohibited wearing the essential safety gear, life jackets, to ensure the red uniform top representing the Marines was visible. Several soldiers, including the Private, were swept away during underwater search operations. While others were safely rescued, the Private remained unrescued and was later discovered as a cold corpse.

Was the commander who gave an illegal and unjust order punished?

Initially, the Marine Corps investigative agency promptly compiled a report detailing the suspicions against the commander and seven others involved and forwarded it to the civilian investigative agency in charge of the incident area, in accordance with South Korea's military court law, which mandates the immediate referral of incidents involving death and sexual assault to civilian investigative agencies regardless of the reason for the incident. However, when the President learned of the report's referral to the civilian agency, he became furious and demanded the deletion of the suspicions against the commander and the cancellation of the referral to the civilian investigative agency.
